Sale Contract Received - What Next?

What now?

We’ve noted below the basic process from here to assist you in knowing what the next step is now that your property is under offer.

  • All parties receive your contract and review it.

  • Where applicable the purchaser may have a cooling off period (3 clear business ​days from the purchaser signing the contact). If they change their mind they may be able to end the contract in this period.

Legal Formalities

  • The legal formalities of the conveyancing are then handled by us. Any points of law, which you are unsure about, should be ​directed to our office.

  • Important dates – The purchaser must pay the deposit in full by the date in the contract.  When an agent is involved, it goes into their trust account.  When no selling agent is involved, it goes into our Trust Account.

  • Subject to loan – Where applicable a contract remains ‘under offer’ till any finance clause has expired or the purchaser confirms it’s approved whichever comes first.   

  • Building & Pest Inspection – If the contract is subject to same, access will need to be granted to a suitable inspector to complete their report. If a purchaser fails to complete one by the expiry date, there is no obligation to let them in.                                                                                                               

  • Lender Involved – If you have a lender noted on your title, contact them now and get a ‘discharge authority’ from them.  Fill it in, sign date and when you send/email it them, include us in that email.  We need it.

Pre-settlement Inspection

  • Anytime within 7 days prior to settlement by law, a purchaser is allowed to inspect the premises before settling, to ensure it is in the same condition when sold. There is an exemption to this rule, being with ​the exception of fair wear and tear. There is no requirement for you to allow more than one ‘final inspection’ in most cases, nor is there any requirement that you have power or gas connected at that time. 

  • Please note: If you receive any request to change, alter or do something you are not 100% sure about, always check with our office first to avoid any possible confusion that may result in a non-legal or contractual obligation. E.g. An agent asks if you fix or do something that you may actually not have to do!

Settlement

  • The settlement date of your property may change from the contract date depending upon the banks and conveyancers/solicitors involved, it will be ​negotiated amongst the parties and agreed.   Generally, this only happens if one party requests it, then all parties agree.  We recommend not agreeing to anything requested by someone other than at our office.  E.g. An agent asks you if you can settle earlier or later.  Check with us first!

  • Keys as applicable – Should be with any agent involved just prior to settlement.  You should not allow access to the purchaser prior to settlement. When in doubt, check with our office.

  • Insurance where a dwelling is at the property – This generally should not be cancelled till settlement has been finalised.
